Colossal Biosciences, a Texas-based startup, is seeking a patent to gain exclusive rights to create and sell gene-edited elephants with woolly mammoth DNA. The company’s patent application, filed in 2023, includes 29 claims aimed at controlling specific mammoth gene variants and animals containing these genetic codes. These claims cover changes in hair, body size, immune system, cold tolerance, and cognitive capacity. The patent, if granted, would last for 20 years, providing a legal framework during the reintroduction of de-extinct species. In the US, patents on genetically engineered organisms have been allowed since 1980, following a Supreme Court decision on an oil-eating bacterium. Colossal has also invested over $400 million in gene-editing and reproductive technologies. The company has used gene editing to insert about 15 DNA changes from the extinct dire wolf into gray wolves, claiming it as the first success in de-extinction technology. Additionally, Colossal has filed trademarks for “Mammouse” and “Woolly Mouse” for use in merchandise.
