8-7 Vote: Court Allows Access to Millions’ Sensitive Data

In a significant ruling, the US Court of Appeals for the 4th Circuit decided by a 2-1 vote to allow DOGE access to personal data held by the US Department of Education and Office of Personnel Management. This decision overturned a lower court’s order. The court’s majority opinion stated that the government demonstrated a strong likelihood of success in their appeal. The vote to stay the lower court’s ruling pending appeal was supported by Judges Steven Agee and Julius Richardson, while Judge Robert King dissented. Additionally, a request for an en banc hearing was denied in an 8-7 vote. The data in question includes highly sensitive information such as Social Security numbers, income details, federal tax records, health histories, and more, belonging to millions of Americans. The plaintiffs in the case include several unions and six military veterans.

According to New York Times reporting as of two hours ago Musk has full and unimpeded access. Courts could be fully subordinated to the Executive branch as a consequence of what Musk does at the Bureau of Fiscal Service.
