3.4 Million Warrantless Searches: FBI’s Privacy Invasion Ruled Unconstitutional

In a landmark decision, US District Judge LaShann DeArcy Hall declared that the FBI’s practice of conducting warrantless searches on communications collected under Section 702 of the Foreign Intelligence Surveillance Act (FISA) violates the Fourth Amendment. The FBI performed 3.4 million such searches in 2021 alone, often on communications inadvertently or mistakenly seized during investigations of foreign terrorists.
