2025: 25 States to Enforce New Privacy Laws

In 2025, eight new state privacy laws will take effect, bringing the total to 25 states with privacy regulations. These laws aim to protect consumer data, with some states like California, Texas, Vermont, and Oregon already having specific regulations for data brokers. These regulations include mandatory registration with the state. The Federal Trade Commission (FTC) has also been active, announcing settlements with data brokers like Mobilewalla and Gravy Analytics for selling sensitive geolocation data without consent. The FTC’s actions are part of a broader effort to limit how data brokers operate, with the Consumer Financial Protection Bureau (CFPB) proposing a rule to designate data brokers as consumer reporting agencies, which would impose stringent reporting requirements and privacy protections. Despite these efforts, the lack of comprehensive federal privacy legislation leaves much of Americans’ personal data vulnerable. Meanwhile, states like Texas are aggressively enforcing their privacy laws, with Attorney General Ken Paxton targeting data brokers involved in breaches and sales to unauthorized entities.
