California’s ambitious climate goals are facing legal challenges as 17 states rely heavily on the state’s Clean Air Act waivers for stricter vehicle pollution rules. According to data from the California Air Resources Board, these states account for a significant portion of light-duty vehicle registrations, with 40% of all new vehicles sold in this category meeting tougher emissions standards.
In addition, 25% of heavy-duty vehicle registrations also meet these stricter standards. The goal is ambitious: by 2035, all new vehicles sold are expected to be electric. To achieve this, states are expanding efforts such as rebates for electric vehicles, tightening fuel rules, and reducing pollution near truck gathering spots.
The Affordable Clean Cars Coalition, launched by New Mexico and other states, aims to defend their rights to transition to cleaner vehicles. As the legal battles unfold, it remains to be seen whether California’s climate goals will prevail or face significant setbacks.

The California waiver rules are improper expansions of a limited Clean Air Act authority and would endanger consumers, our economy, and our nation’s energy supply.
I look forward to overturning them in the very near future.

More smog. More asthma. More pollution in our kids’ lungs.
The U.S. Senate’s vote to overturn California’s clean air rules is illegal and defies decades of precedent. We will go to court to fight this unconstitutional attack.
