In a notable incident, Morgan & Morgan, a prominent U.S. law firm, faced a significant issue when one of its attorneys, Rudwin Ayala, cited eight non-existent cases in a lawsuit against Walmart. These cases were generated by AI, specifically ChatGPT, and could not be found in any legal database. This blunder led to Ayala’s immediate removal from the case and his replacement by T. Michael Morgan, Esq. The firm’s chief transformation officer, Yath Ithayakumar, warned all 1,000+ attorneys that using AI-generated fake citations could result in disciplinary actions, including termination. Over the past two years, at least seven cases have been disrupted by lawyers citing AI-generated fictitious cases. Some faced sanctions, like a $5,000 fine for using chatbot “gibberish” in filings, while another lawyer was fined $2,000 and mandated to attend a course on AI use in law. However, not all faced penalties; Michael Cohen, Donald Trump’s former lawyer, avoided sanctions despite providing his attorney with fake case citations.
