Eli Lilly has initiated legal action against Strive Pharmacy and Empower Pharmacy. The lawsuits, filed in Delaware and New Jersey, claim these pharmacies are producing unauthorized versions of Zepbound and Mounjaro. The active ingredient in these drugs, tirzepatide, saw a 90% reduction in compounding last month following an FDA directive. Despite this, Strive and Empower continue to produce altered versions of tirzepatide, which they supply to telehealth platforms like Lavender Sky Health and Mochi Health. Lilly argues that these pharmacies are mass-producing these drugs rather than customizing them for individual needs, a practice allowed only during drug shortages or for specific medical reasons. The outcome of these lawsuits could set a precedent for similar cases involving other pharmaceuticals like Novo Nordisk’s Wegovy and Ozempic, which face similar compounding restrictions starting in May.
