80% of AI Lawsuits Hinge on Copyright: The Battle Over Fair Use

In the ongoing debate over AI training and copyright, 80% of lawsuits involve AI companies, including OpenAI, clashing with rights holders. These disputes center on whether training AI models on copyrighted works constitutes fair use. A significant ruling found that AI training is not fair use, as it threatened to replace Westlaw in the market. OpenAI argues that its models transform copyrighted works by extracting patterns and insights, not replicating them for public consumption. They claim this aligns with copyright’s core objectives and the fair use doctrine. OpenAI has suggested that the upcoming AI Action Plan should declare AI training as fair use to end these legal battles. They warn that without this, China may gain an advantage by accessing copyrighted data that U.S. companies cannot.
