50% of Crypto Market Could Be Classified as Securities, SEC Suggests

The U.S. Securities and Exchange Commission (SEC) is actively engaging with the crypto industry to develop a regulatory framework for digital assets. At the SEC’s first crypto-focused roundtable, Commissioner Hester Peirce, head of the agency’s crypto task force, emphasized the need for a “workable framework” to oversee transactions. The task force aims to create a taxonomy that encompasses the diverse types of crypto assets currently and potentially in the future. Acting Chairman Mark Uyeda indicated that while memecoins and mining are not currently subject to securities laws, it’s a “definite possibility” that other areas of the crypto sector could be classified as securities. This roundtable, involving the entire three-member commission, is exploring potential interpretations of securities laws for crypto assets. The discussion included input from a dozen securities attorneys from the crypto sector, highlighting the complexities and uncertainties in applying traditional securities regulations to digital assets.
