Tornado Cash was blacklisted in 2022 for allegedly laundering $445 million stolen by the North Korea-linked Lazarus cybercrime group. The U.S. Treasury recently removed Tornado Cash from its global blacklist and over 100 ether addresses from the Specially Designated Nationals list. Despite this, Coinbase’s chief legal officer, Paul Grewal, criticized the Treasury’s claim that the delisting made a final court judgment unnecessary. Grewal argued that without a final ruling, there’s no assurance Tornado Cash won’t be re-sanctioned. He cited the FBI v. Fikre case, where the Ninth Circuit ruled that voluntary cessation of challenged conduct does not moot a case unless it’s unlikely to recur. The Treasury’s action followed a court filing on March 21, but Grewal believes it’s an attempt to sidestep a ruling from the Fifth Circuit Court of Appeals.
